Participant Waiver, Assumption of Risk, Release of Liability & Media Authorization

By registering for and/or participating in the Wurst Tri Ever Triathlon (“Event”), I acknowledge that I have read, understand, and voluntarily agree to the terms below. If I am signing on behalf of a minor participant, I certify that I am the parent or legal guardian and agree to all terms on behalf of the minor
Assumption of Risk
I understand that participation in the Wurst Tri Ever Triathlon involves significant inherent and unforeseeable risks, including but not limited to: Open-water swimming, including drowning, panic, fatigue, submerged objects, reduced visibility, water quality concerns, aquatic wildlife, contact with other swimmers, and changing water conditions; Cycling on public or partially closed roads, including collisions with vehicles, bicycles, pedestrians, volunteers, road hazards, uneven pavement, gravel, potholes, wet surfaces, debris, mechanical failure, and falls; Running on roads, sidewalks, trails, or uneven surfaces; Extreme weather conditions including heat, cold, wind, rain, lightning, flooding, and humidity; Physical exertion including dehydration, heat exhaustion, heat stroke, cardiac events, respiratory distress, illness, and other medical emergencies; Negligence or acts of other participants, spectators, volunteers, vendors, contractors, or members of the public; Exposure to communicable illnesses; Delays or lack of immediate emergency response due to event location or circumstances; Any other known or unknown risks associated with participation in a triathlon. I knowingly and voluntarily assume all risks of injury, illness, property damage, permanent disability, and death arising out of or related to participation in the
Medical Fitness / Participant Responsibility
I certify that:
- I am physically able and sufficiently trained to participate.
- I have not been advised otherwise by a physician;
- I understand the physical demands of a triathlon;
- I accept full responsibility for monitoring my own condition before and during the Event;
- I will immediately stop participation if I experience symptoms that could endanger myself or others.
If I am pregnant, recently injured, ill, or have any medical condition affecting participation, I understand that I am responsible for consulting my physician before participating.
Bicycle, Helmet & Equipment Requirements
I understand and agree with that:
A properly fitted bicycle helmet that meets current CPSC and/or USA Triathlon standards is required during the cycling portion; the helmet's chin strap must remain fastened at all times while riding. My bicycle and equipment are in safe operating condition; I am solely responsible for inspection, maintenance, and safety of my equipment; Event staff may remove me from participation if equipment is unsafe or rules are not followed. Releasees are not responsible for lost, stolen, or damaged equipment or personal belongings.
Compliance With Event Rules
I agree to:
Follow all instructions from race officials, volunteers, law enforcement, medical personnel, and course marshals; Obey all traffic laws and posted signage; Conduct myself safely and respectfully; Refrain from unsportsmanlike, reckless, or dangerous conduct.
Personal Best Events, LLC reserves the right to deny participation, remove, or disqualify any participant without refund for safety violations, rule violations, or behavior that threatens people or property.
Emergency Medical Authorization
If I become injured or unable to respond, I authorize event staff, EMS personnel, physicians, or medical providers to provide medical treatment and/or transport as deemed appropriate.
I understand:
Medical personnel may not be immediately available; I am financially responsible for any medical expenses, ambulance transport, hospital care, or related treatment. Releasees are not responsible for medical decisions made in an emergency.
Release of Liability / Waiver / Covenant Not to Sue
In consideration for being allowed to participate, I, on behalf of myself and my heirs, estate, personal representatives, successors, assigns, and family members, hereby fully release and forever discharge:
Personal Best Events, LLC, all sponsors, partners, venue owners, municipalities, counties, state agencies, volunteers, vendors, contractors, event staff, officers, directors, employees, officials, and affiliated organizations (collectively “Releasees”) from any and all claims, liabilities, demands, damages, costs, attorney’s fees, actions, causes of action, or losses of any kind arising from or related to participation in or attendance at the Event, including injury, illness, disability, death, or property loss, whether caused by negligence or otherwise, to the fullest extent permitted under Texas law.
I further agree not to sue Releasees for any matter arising from participation or attendance.
Indemnification
I agree to indemnify, defend, and hold harmless Releasees from any claims, damages, liabilities, losses, or expenses—including attorney’s fees—arising from: My participation; My actions or negligence; Damage I cause to persons or property; Claims brought on behalf of a minor participant I register.
Timing & Results Disclaimer
I understand that race timing and posted results are provided in good faith but may be affected by weather, participant error, equipment malfunction, chip damage, missed mats or antennas, lost bibs, communication issues, or unforeseen technical issues.
Official race decisions and results made by the Event are final.
Photography / Video / Media Release
I grant Personal Best Events, LLC and event partners permission to photograph, record, live stream, reproduce, publish, distribute, and use my name, image, likeness, voice, race results, for promotional, editorial, advertising, marketing, website, and social media purposes in any format now known or later developed, without compensation or approval.
I waive any right to inspect or approve the final use.
Minor Participant Authorization (if applicable)
For participants under 18 years of age:
I certify I am the parent/legal guardian.
I: authorize participation; understand all risks; assume responsibility for the minor; release Releasees on behalf of the minor; agree to indemnify Releasees for claims involving the minor.
Any participant under age 18 must comply with event age rules and may be required to have an adult present throughout participation. Parent/Guardian Name: Relationship: Signature: Date.
Refund / Cancellation / Transfer Policy
Refund requests:
14 or more calendar days before race day: 50% refund of entry fee minus registration platform fees and USAT fees
Less than 14 days before race day: no refunds
Additional policies: No transfers, No bib transfers, No deferrals unless specifically announced by Event management
If the event is delayed, modified, shortened, postponed, or canceled due to weather, flooding, lightning, acts of God, public safety concerns, government orders, venue restrictions, emergencies, or circumstances beyond the event's control, there are no refunds, transfers, credits, or reimbursements.
Event management may alter course distances, start times, transition areas, or safety procedures at any time.
Governing Law / Venue
This agreement is governed by the laws of the State of Texas.
Any legal action relating to this agreement or Event must be brought exclusively in courts located in Comal County, Texas.
Severability
If any portion of this agreement is held invalid or unenforceable, all remaining provisions remain fully enforceable.
Acknowledgment
By registering and/or signing below, I acknowledge that: I have carefully read this entire agreement; I understand its contents; I understand I am waiving legal rights; I voluntarily agree; I intend this release to be legally binding.
