LONERRUNNER RUN CLUB – LUCHA LIBRE CARRERA 5K

PARTICIPANT WAIVER, RELEASE OF LIABILITY AND PHOTO RELEASE

PLEASE READ CAREFULLY. THIS IS A RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS.

By registering for and participating in the LonerRunner Run Club – Lucha Libre Carrera 5K in Fort Stockton, Texas, I acknowledge and agree to the following:

ASSUMPTION OF RISK

I understand that participating in a 5K event involves inherent risks, including the risk of serious injury, illness, disability, death, and property damage or loss. These risks may include, but are not limited to, risks caused by terrain, roads, facilities, temperature, weather conditions, vehicular traffic, equipment, the physical condition of participants, the actions or negligence of other participants, volunteers, spectators, or other persons, and the availability or lack of hydration or medical assistance.

I voluntarily choose to participate and ASSUME ALL RISKS associated with my participation in the event, including those arising from the negligence or carelessness of the persons or entities released below, to the fullest extent permitted by law.

I certify that I am physically fit to participate and have not been advised by a qualified medical professional not to participate. I understand that it is my responsibility to determine whether I am physically capable of participating in this event.

WAIVER AND RELEASE OF LIABILITY

In consideration for being permitted to participate in the LonerRunner Run Club – Lucha Libre Carrera 5K, I, for myself and on behalf of my heirs, executors, administrators, personal representatives, successors, and assigns, hereby WAIVE, RELEASE, AND DISCHARGE from any and all liability, claims, demands, actions, or causes of action for death, personal injury, illness, disability, property damage, property theft, or any other loss or damage arising out of or related to my participation in the event, including travel to and from the event, to the fullest extent permitted by law.

This release applies to LonerRunner Run Club, Lucha Libre Carrera, Personal Best Events, LLC, event organizers, sponsors, volunteers, agents, representatives, contractors, and all other persons or entities associated with the event.

INDEMNIFICATION AND AGREEMENT NOT TO SUE

I agree to INDEMNIFY, HOLD HARMLESS, AND NOT SUE the entities and persons listed above for claims or liabilities arising out of my participation in the event, whether caused by negligence or otherwise, to the fullest extent permitted by applicable law.

PHOTO AND VIDEO RELEASE

I grant LonerRunner Run Club, Lucha Libre Carrera, Personal Best Events, LLC and its organizers, representatives, sponsors, and volunteers permission to photograph, videotape, and digitally record me during the event. I authorize the use of my image, likeness, name, and voice in photographs, videos, social media, websites, promotional materials, advertising, and other media now known or later developed, without compensation or further approval.

I understand that I waive any right to inspect or approve the finished materials and that I will receive no financial or other compensation for their use.

ELECTRONIC ACKNOWLEDGMENT AND AGREEMENT

By checking the box below and completing my registration, I certify that:

• I have carefully read and fully understand this Participant Waiver, Release of Liability and Photo Release.

• I understand that I am giving up certain legal rights, including the right to bring certain claims against the released parties.

• I voluntarily agree to all terms and conditions of this waiver.

• I understand and voluntarily assume the risks associated with participating in the event.

• I certify that I am physically able to participate.

• I agree that my electronic acceptance of this waiver has the same force and effect as my original handwritten signature.

• I am at least 18 years old, or, if registering a minor, I am the parent or legal guardian of that participant and have the legal authority to accept this waiver on the minor's behalf.

I HAVE READ, UNDERSTAND, AND VOLUNTARILY AGREE TO THE PARTICIPANT WAIVER, RELEASE OF LIABILITY AND PHOTO RELEASE.
